Section 1: Services & Products

AI Disclosure

Victoria Studer, dba Next Day Teaching (“Company”, “we”, or “us”) may use artificial intelligence (“AI”) tools at its discretion in connection with the operation of its business, website, products, services, marketing, and content creation, including but not limited to the uses described below.

AI-Generated Intake Responses

Client agrees to complete all intake forms, questionnaires, and discovery materials using their own original responses. Responses generated or substantially drafted by artificial intelligence tools, including but not limited to ChatGPT, Claude, Gemini, or similar large language models, are not permitted. Client understands that intake materials are used by Company to assess Client’s goals, circumstances, needs, preferences, and other individualized information, and that AI-generated responses may undermine the accuracy and effectiveness of Company’s work.

Client may use voice-to-text or transcription tools (such as Whispr Flow, Otter.ai, or similar) to capture and transcribe their own spoken responses, provided the substance of the response originates with the Client.

AI Feedback on Deliverables

Client agrees that feedback, questions, and requests for changes regarding any individualized materials, recommendations, plans, or other deliverables provided by Company will reflect Client’s own opinions, experiences, needs, and direction. Client agrees not to submit Company’s individualized materials or deliverables to an artificial intelligence tool for the purpose of generating, supplementing, or informing feedback, and agrees not to request that Company modify individualized materials or recommendations based on AI-generated critiques or suggestions. Client acknowledges that Company’s professional and coaching decisions are intentional and may take into account individualized circumstances that AI-generated feedback may not fully understand or consider.

Client may use AI grammar or spell-check tools (such as Grammarly) on written materials for the limited purpose of identifying typographical errors, provided no substantive feedback or revision requests are derived from such tools.

Prohibition on AI Training Using Deliverables

Client agrees not to input, upload, or otherwise submit any individualized deliverable or other proprietary material provided by Company in connection with Client’s services into any artificial intelligence system, machine learning model, or automated tool for the purpose of training, fine-tuning, or otherwise developing an AI model. This restriction applies regardless of whether the deliverable has been published or made publicly available. Client retains the right to use deliverables as set forth in this Agreement, but ownership of the underlying intellectual property remains with Company unless otherwise expressly stated, and no license to use Company’s work for AI training purposes is granted.

Prohibition on AI Use of Company’s Likeness

Client agrees not to upload, submit, or otherwise use any photographs, video footage, or other depictions of Company, whether delivered as part of this Agreement or obtained elsewhere, as inputs into any artificial intelligence image generation, video synthesis, or likeness replication tool. This prohibition applies to promotional materials, social media content, advertisements, and any other use case. Any AI-generated content depicting Company’s likeness, voice, or appearance, whether realistic or stylized, requires Company’s  separate, express written consent prior to creation or use.

Feedback and Advice From Third Parties

To protect the integrity of the coaching and professional relationship, Client agrees that feedback, questions, and requests for changes regarding individualized services or deliverables will originate from Client. Client agrees not to request that Company revise individualized services or deliverables based primarily on recommendations from artificial intelligence tools or other third parties without prior written consent from Company.

Provider’s AI Use Policy and Client Asset Disclosure

Company may use generative artificial intelligence and other AI-powered tools in connection with its business operations, content creation, marketing, research, analysis, search engine optimization, and other business activities. Company may use AI for brainstorming and organizing ideas; analyzing newsletter and marketing patterns; creating or assisting with graphics; developing SEO materials such as meta titles, descriptions, and FAQs; creating Pinterest pin titles, text, and descriptions; and other similar purposes. Company reviews AI-assisted work and exercises its own judgment regarding the final content, materials, and decisions produced or published by Company.

Client represents and warrants that any digital assets, designs, logos, or other materials submitted to Company for use in fulfilling this Agreement, whether created by Client or by a third-party designer on Client’s behalf, were not generated in whole or in part using generative artificial intelligence tools. Client agrees to disclose, prior to project commencement, any known or suspected use of generative AI in the creation of assets they are providing to Company.

Section 2: Courses & Programs

Prohibition on AI Ingestion of Course Materials

Student agrees not to input, upload, copy, or otherwise submit course materials, including but not limited to videos, transcripts, workbooks, templates, scripts, slide decks, and community content, into any artificial intelligence tool for any purpose, including but not limited to generating summaries, creating study guides, producing derivative content, or training or fine-tuning an AI model. Student understands that doing so may constitute a copyright infringement as well as a breach of this contract. “Course materials” includes all content provided by Company, whether delivered through the course platform, via email, in a community space, or on a live call.

Prohibition on AI Notetakers on Calls

Client/Student agrees not to use any AI-powered notetaking, recording, transcription, or meeting intelligence tool (including but not limited to Otter.ai, Fireflies, Fathom, or similar) on any live group call, coaching call, or community session without prior written consent from Company. Student understands that live calls may include confidential information, personal disclosures from other participants, and proprietary content from Company, and that the use of AI notetakers in these spaces is prohibited to protect the privacy and safety of all participants.

Company may make recordings or AI-generated transcripts available to Students through the course platform at Company’s discretion. Any such materials are subject to all other restrictions in this Agreement.

Prohibition on Copying or Exporting AI Tools

Where Company makes AI tools, chatbots, or automated assistants available within the program, Student agrees not to copy, replicate, reverse-engineer, export, or otherwise reproduce those tools outside of the designated platform. Company’s access to any AI tools provided by Company is a limited, non-transferable license that exists solely within the scope of the Student’s enrollment and terminates upon the conclusion of the program or cancellation of access.

Permitted Use of Creator-Provided AI Tools

Where Company makes AI tools available within the program, Student may use those tools solely for their own personal educational and business use in connection with the program. Student agrees not to: (a) share access to those tools with third parties; (b) use those tools to generate content that reproduces or substantially replicates Company’s proprietary materials; or (c) use those tools in any manner inconsistent with the program’s terms or the spirit of this Agreement.

Speaker Likeness and Recording Restrictions

Organizer agrees not to use any photographs, video recordings, audio recordings, or other captured depictions of Speaker, whether taken at the event, provided by Speaker for promotional purposes, or obtained through any other means, as inputs into any artificial intelligence tool. This includes but is not limited to: AI image generation tools used to create promotional or marketing materials, video or audio synthesis tools, transcription or summarization tools that process Speaker’s recorded presentation, and any platform used to train or fine-tune an AI model. Organizer further agrees not to grant any third party permission to use Speaker’s likeness or recorded content for any of the foregoing purposes. Any use of Speaker’s likeness or recorded content beyond standard event promotion requires Speaker’s separate, express written consent prior to use.

Section 3: Provider-Side Disclosures

Limitation of Liability — AI Tool Outputs

AI tools used or provided by Company may produce errors, omissions, or inaccuracies. Company makes no warranty as to the accuracy or completeness of AI-generated outputs and is not liable for any decisions made in reliance on those outputs.

Disclosure of AI Use in Business Operations & Service Delivery

Company may use artificial intelligence tools in connection with business operations, coaching and other services, research, drafting, ideation, analysis, search engine optimization, marketing, graphic creation, and other content or administrative tasks. Company reviews and refines AI-assisted work prior to use or delivery and exercises professional judgment regarding the final work product, regardless of the tools used in its creation.

Data Handling — AI Tools Used by Company

Company may use third-party AI platforms in connection with business operations, content creation, research, analysis, and other activities. Company takes reasonable steps to avoid submitting unnecessary personally identifiable information or sensitive information to AI tools and generally anonymizes or removes identifying details before submitting information to such tools. Company does not intentionally submit Client or Customer payment information, passwords, or other sensitive personal information to AI tools for processing. Information submitted to third-party AI platforms may be processed in accordance with the privacy policies and terms of those platforms.

AI-Assisted Content

Some Company content, marketing materials, graphics, and other materials may be created or developed with assistance from artificial intelligence tools. AI may be used for brainstorming, organization, analysis, editing, search engine optimization, marketing content, graphic creation, and other supporting functions. Company does not represent that all content or materials published or sold by Company are created entirely without AI assistance.
